This Privacy Policy explains how Robert Tauscher – Sway Media ("we", "us") collects, uses, and shares information when you use the FREESBIATCH website (the "Service"). It is written primarily for US visitors, including residents of California and other states with consumer privacy laws. We are based in Germany, so processing of EU/UK visitor data is also subject to GDPR — see our German-language Datenschutzerklärung for that audience.

2. Information We Collect
- Technical data: IP address, browser type, device type, pages visited, referral source
- Usage data: which categories/beats you interact with, session activity
- Age confirmation (18+ click-through, not tied to identity documents)
- Voting data: a one-way hash of your IP address, stored for up to 48 hours, to prevent duplicate votes on the "Charts" feature — never stored in plain text

4. Cookies and Tracking Technologies
This Service currently does not use analytics or advertising cookies. Only technically necessary functionality is used (e.g. session/category preferences held in your browser). A cookie consent banner is nonetheless shown on your first visit, letting you choose "Necessary only" or "Accept all"; the Statistics and Marketing categories are already built in but are not active yet. You can change your choice at any time via the "Cookie Settings" link in the footer. If analytics or advertising partners are actually added in the future, this policy will be updated accordingly, and consent will be obtained in advance through this same banner, along with a "Do Not Sell or Share My Personal Information" option where required.
5. State Privacy Rights (California and others)
If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the CPRA, gives you the right to:
- Know what personal information we collect and how it's used
- Delete personal information we hold about you
- Correct inaccurate personal information
- Opt out of the "sale" or "sharing" of personal information
- Non-discrimination for exercising these rights

6. Children's Privacy (COPPA)
The Service is intended for users 18 and older and is not directed at children under 13. We do not knowingly collect personal information from children under 13. If we learn we have inadvertently collected such information, we will delete it.
7. Data Retention
Technical log data is retained only as long as necessary for security and operational purposes. Voting-related IP hashes are automatically deleted after 48 hours.
8. International Data Transfers
Because our company is based in Germany and the Service is delivered via Cloudflare's global network, information may be processed on servers located outside your home country, including in the European Union and the United States. Cloudflare relies on the EU-US Data Privacy Framework and/or EU Standard Contractual Clauses for such transfers where applicable.
9. Security
We use reasonable technical and organizational measures to protect personal information, including hashing sensitive identifiers before storage. No method of transmission or storage is completely secure.
10. Changes to This Policy
We may update this Privacy Policy periodically. Material changes will be indicated by updating the "Last updated" date above.
